Privacy Policy

This Privacy Policy describes how MyAgentForLess ("we," "us," or "our"), a real estate team brokered by HomeSmart and serving the Phoenix metro area, including Maricopa and Pinal counties, Arizona, handles personal information collected through myagentforless.com (the "Site"), our consultation forms, and the customer relationship management ("CRM") system we use to respond to inquiries.

This policy covers the Site only. Information you provide during a real estate transaction (for example, in listing agreements, offers, or closing documents) may also be handled under HomeSmart's Privacy Policy and applicable real estate law.

Information you give us

• Seller consultation form: full name, email address, phone number, property address, and estimated home value range.
• Buyer consultation form: full name, email address, phone number, and, if you choose, desired neighborhood(s) and budget range.
• Anything else you share with us by phone, text, or email, and notes our team records while working with you.

Information collected automatically

• Visit and source details: the page where you first arrived on the Site (including any campaign tags in the web address, such as utm_source or gclid), the referring website, and the page you submitted a form from. These are attached to your form submission.
• Advertising click identifiers: if you arrive from a Google ad, the Google Click ID ("gclid") in the web address.
• Device and usage information collected by the analytics and advertising tools described in Section 5, such as IP address, browser and device type, pages viewed, and interactions with the Site.

We collect information directly from you, automatically from your browser or device when you use the Site, and from the analytics and advertising providers we use (for example, reports about how visitors found and used the Site). If you submit a lead form in one of our ads on Facebook or Instagram, Meta provides us with the information you entered in that form.

• To respond to your inquiry and provide the real estate information or services you request.
• To contact you by phone, text message, or email as described in Section 8.
• To track and manage inquiries in our CRM, including recording their status and notes.
• To understand how visitors use the Site and improve its content.
• To measure whether our advertising leads to inquiries, and to help advertising platforms optimize our ads.
• To protect the Site, prevent fraud or misuse, and comply with legal obligations.

The Site uses the following third-party technologies:

• Google Tag Manager, which loads and manages tags on the Site.
• Google Analytics 4, which collects information about your visit and interactions using cookies and similar technologies.
• Google Ads conversion tracking, which helps us learn when a visit from one of our ads results in a form submission.
• OpenAI advertising measurement, a script that records when a form is submitted so we can measure advertising placed through OpenAI.
• Google Fonts, which delivers the Site's typefaces from Google's servers; your browser shares your IP address with Google to load them.

The Site may also use the Meta Pixel, which collects information about your visit and actions on the Site (such as pages viewed and form submissions) using cookies and similar technologies, so we can measure and improve our ads on Facebook and Instagram.

Information shared with Google Ads to measure advertising

If you contact us after clicking one of our Google ads, we may later share information with Google Ads about the results of that inquiry. This can include the Google Click ID, general information about how the inquiry progressed, and your email address and phone number. Before we send your email address and phone number, we convert them into a coded (hashed) form. Hashed information is still personal information, because Google uses it to match the data to its own account records. We use this information to measure how well our advertising works and to help Google improve the delivery of our ads.

Third parties, including Google and Meta, may use cookies, web beacons, and other storage technologies to collect or receive information from the Site and elsewhere on the internet, and use that information to provide measurement services and target ads. You can learn how Google uses information from sites that use its services at policies.google.com/technologies/partner-sites, and manage how Meta uses this information for ads at facebook.com/adpreferences and facebook.com/off_facebook_activity. You can also opt out of interest-based advertising from participating companies at optout.aboutads.info. You can review OpenAI's privacy policy at openai.com/policies/privacy-policy.

We share personal information with:

• Service providers that host the Site and our CRM database, deliver email notifications, and deliver text-message alerts about new inquiries to our team.
• Analytics and advertising providers (Google, Meta, and OpenAI) as described in Section 5.
• Our brokerage (HomeSmart), and, with your direction or as needed for your transaction, parties such as lenders, title and escrow companies, and other agents, but only after you become a client. One exception: if you ask us for a referral, for example to a lender to get qualified for a loan, we share the information needed to make that introduction at your request, even before you become a client. Otherwise, information from an inquiry that never becomes a client relationship is not shared with these parties.
• Legal and safety recipients when required by law or to protect rights, property, or safety, and in connection with a business transfer.

We may also use and share de-identified or aggregated information that cannot reasonably be used to identify you.

Some state privacy laws treat providing information to advertising platforms for targeted or cross-context advertising as a "sale" or "sharing" of personal information. We do not sell your personal information for money.

The tools in Section 5 use cookies and similar technologies. The Site also stores the Google Click ID and the first page you visited in your browser's local storage so they can be attached to a later form submission.

The Site does not currently offer a cookie banner or an on-site setting to turn these technologies off. You can:

• Block or delete cookies and site data in your browser settings.
• Install the Google Analytics opt-out browser add-on.
• Manage personalized Google ads at myadcenter.google.com.
• Manage how Meta uses your information for ads at facebook.com/adpreferences.
• Opt out of interest-based advertising from participating companies at optout.aboutads.info.

The Site does not currently respond to browser "Do Not Track" or Global Privacy Control signals.

When you submit a consultation form, you authorize our team to contact you by phone, text message, or email to respond to your inquiry. Marketing calls and texts are made only as permitted by law and with any consent required, and consent to marketing calls or texts is not a condition of any purchase. Message and data rates may apply and message frequency may vary.

Opting out

• Text messages: reply STOP to any text. Reply HELP for help.
• Email: use the unsubscribe link in any marketing email, or reply asking us to stop.
• Phone calls: tell us by phone, text, or email that you no longer want calls.

After you opt out, you may receive one final message confirming your request.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties, except as required by law or as necessary to deliver text message services.

We use reasonable safeguards, including encrypted connections to the Site and restricting CRM access to signed-in, authorized team members. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a security incident affects your personal information, we will notify you as required by applicable law.

We keep personal information for as long as needed to respond to your inquiry, serve you as a client, and meet legal, regulatory, and brokerage recordkeeping requirements. Specifically:

• Inquiries that become clients (listing or buyer representation): kept for at least 5 years after the transaction or representation ends, as required by Arizona brokerage recordkeeping rules.
• Inquiries that do not become clients: kept for up to 5 years from the last contact, including records of contact consent and opt-out requests.
• Analytics and advertising data: kept by Google, Meta, and OpenAI under their own retention settings.

Depending on where you live and whether a particular law applies to us, you may have rights to request access to, correction of, or deletion of your personal information, or to opt out of targeted advertising or the sale or sharing of personal information. Whether or not a law requires it, you may contact us with any of these requests and we will review them and respond as applicable law allows.

To make a request, email team@myagentforless.com or call 602-935-5554. We may need to verify your identity before acting on a request, and some information may need to be kept for legal or recordkeeping reasons. Corrections apply going forward and do not change information already shared with others before the correction. Deleted information may remain in backup systems for a limited time until those backups are replaced; while it remains there, it receives the same protections as our other records. If we decline your request, you may reply to ask us to reconsider. We will not discriminate against you for making a request.

The Site is intended for adults 18 and older and is not directed to children. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

The Site contains links to third-party websites that we do not own or operate, including our brokerage and companies we work with or recommend, such as title, escrow, mortgage, and other real estate service providers. These links are provided for your convenience and as potential resources, for example, when you ask us for a referral. The companies we link to may change over time as our relationships change, and we may add links to other businesses in the future.

If you click a link to a third-party website, that website's own privacy policy applies to anything you do there, and this policy no longer governs your activity on that site. We do not control third-party websites and are not responsible for their content, security, or privacy practices. We encourage you to review the privacy policy of every website you visit, including our partners' sites, before providing them any personal information.

We may update this policy from time to time. We will post the updated version on this page with a new effective date.
